By purchasing, downloading, installing, or using XAUVANT (the “Software”), you (“User”) agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms in their entirety, you must not purchase, download, or use the Software.
These Terms constitute a legally binding agreement between you and XAUVANT (“we”, “us”, or “our”). By completing a purchase, you confirm that you are at least 18 years of age, legally capable of entering into contracts, and that you have read and understood these Terms.
XAUVANT is a proprietary software application (“the Software”) for Windows that automates the analysis and execution of trades on the XAUUSD (Gold/USD) pair via the MetaTrader 5 (MT5) trading platform. The Software uses technical signal analysis, the Agent Desk multi-agent decision layer (including hard-coded risk and location rules), artificial intelligence via the Anthropic Claude API as Desk Chief, and a Bayesian self-learning system to generate and manage trade orders.
XAUVANT does not provide financial advice, investment advice, or brokerage services. The Software is a tool that automates a user-configured trading strategy. All trading activity occurs through your own broker account, which XAUVANT does not control or operate.
Upon successful payment and account activation, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the Software solely for your own personal trading activities, subject to these Terms.
Each license permits installation on up to two (2) machines simultaneously (for example, a personal computer and a VPS). Installation on additional machines requires the purchase of a separate license. If you require more than two machines, contact us at support@xauvant.com.
Licenses are sold for fixed durations: 1 month, 3 months, 6 months, 1 year, or lifetime. A “lifetime” license means the life of the product — the period during which XAUVANT is actively developed and maintained. Upon expiry of a fixed-term license, access to the Software will be suspended until a new license is purchased.

Access to the Software requires authentication via your registered email address using a one-time magic link sent to your inbox. You are responsible for maintaining the security of your email account. Any activity authenticated through your email address is your responsibility.
If you believe your account has been compromised, contact us at support@xauvant.com immediately. We may revoke access pending investigation.
The Software caches an authenticated session locally for up to 24 hours. An offline grace period of 7 days applies in the event of internet connectivity issues. Beyond this period, re-authentication is required.
All payments are processed securely by Stripe, Inc. We do not store your payment card details. All prices are listed in US dollars (USD) and are exclusive of any applicable taxes. You are responsible for any taxes applicable in your jurisdiction.
All plans are one-time payments. There are no automatic renewals or recurring charges. To continue using the Software after a fixed-term license expires, you must manually purchase a new plan.
License access is tied to the email address used at the time of purchase. Please ensure you use a valid, accessible email address when purchasing.
All sales are final. Due to the immediate digital delivery of a license and the nature of the product, we do not offer refunds, exchanges, or credits under any circumstances, including but not limited to: change of mind, incompatibility with your broker or system, failure to generate trading profits, or technical issues attributable to your broker, MT5 installation, or internet connection.

Where consumer protection law in your jurisdiction mandates a right of return or refund that cannot be waived by contract, those statutory rights apply. In such cases, contact us to discuss your situation.
We may offer a 7-day free trial at our discretion upon request to support@xauvant.com. Trial licenses provide full access to the Software for the trial period. Trial licenses expire automatically after 7 days. Trials are limited to one per person. We reserve the right to refuse trial requests at our sole discretion.

The Software is provided “as is” and “as available” without any warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation.
We do not warrant that:
Scheduled maintenance, third-party API outages (including Anthropic, MetaQuotes, or data providers), and broker-side issues may cause temporary unavailability of some features. Such events do not constitute a breach of these Terms and do not entitle you to a refund.
To the maximum extent permitted by applicable law, XAUVANT and its developers shall not be liable for any:

You agree to use the Software only for lawful purposes and in accordance with these Terms. You must not:
You are responsible for ensuring that your use of automated trading software complies with your broker’s terms of service and all applicable laws in your jurisdiction.
The Software, including all underlying code, algorithms, AI prompts, documentation, design, and all intellectual property rights therein, are and remain the exclusive property of XAUVANT. These Terms grant you no ownership interest in the Software. All rights not expressly granted are reserved.
The XAUVANT name, logo, and branding are proprietary. You may not use them without prior written consent.
We may suspend or permanently revoke your license, with immediate effect and without prior notice, if:
Upon revocation for breach, no refund will be issued. Upon expiry of a fixed-term license through normal use, the license simply lapses until renewed — this is not a “termination” under this section.
You may terminate your use of the Software at any time by ceasing to use it. No refund is issued for unused license time.
We reserve the right to modify, update, or discontinue the Software or any feature at any time. We will endeavour to provide reasonable notice of significant changes via the website or email. Feature changes or updates do not constitute grounds for a refund.
Updates to the Software are included with all active licenses and are delivered automatically through the built-in updater.
These Terms are governed by and construed in accordance with applicable law. Any dispute arising out of or in connection with these Terms that cannot be resolved by good-faith negotiation shall be submitted to the courts of competent jurisdiction.
Before initiating any formal dispute, you agree to contact us at support@xauvant.com and give us a reasonable opportunity (no less than 30 days) to resolve the matter.
We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. For material changes, we will notify active users by email. Your continued use of the Software after any update constitutes your acceptance of the revised Terms.
